Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Erkundung eines bei Aushubarbeiten vorgefundenen Kanals durch eine Kamerabefahrung ist erforderlich, da dieser bei keinem der uns vorliegenden Bestandspläne bekannt war.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Bei Aushubarbeiten zur Spartenumverlegung wurde ein unbekannter Kanal DN800 vorgefunden. Da dieser mit dem Baufeld kollidiert, muss er in dem für die Baumaßnahme störenden Bereich rückgebaut werden. Ohne den Rückbau des Kanals können für die Erneuerung der EÜ relevante Maßnahmen nicht ausgeführt werden. Ohne Kamerabefahrung kann jedoch keine Aussage über Art, Beschaffenheit und Funktion und die Möglichkeit des Abbruchs gemacht werden, da dervorgefundene Kanal in keinem der der Planung zugrunde liegenden Bestandsplänen dargestellt ist. Die Existenz des Kanals war vor den Aushubarbeiten nicht bekannt, die Notwendigkeit einer Kamerabefahrung konnte daher nicht vorhergesehen werden
