Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Es sind weitere Planungsstunden, also Mehraufwände, bzw. eher Mengenmehrung der Planungsstunden notwendig geworden,

da sich die Abstimmungen zu Parallelmaßnahmen aufwendiger gestalten, als bei Beauftragung angenommen.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Aufgrund dessen, dass der Autragnehmer keine zusätzliche Objekte beplanen soll, sondern ausschließlich im Zuge derGrundlagenermittlung erhebliche Mehraufwände hat, bzw. weitere Planungsstunden braucht, ist eine anderweitige Vergabe nichtmöglich. Die zusätzlichen Planungsstunden sind auf notwendige, umfangreiche Abstimmungsbedarfe zu Parallelmaßnahmen undangrenzenden Teilsystem zurrück zu führen. Die Schnittstellenabstimmung ist zur Sicherstellung des Werkserfolges notwendig.Die Bindung eines neuen Planers ist nicht wirtschaftlich, da sich der bereits gebundene und der neue Planer sich thematischintensiv austuaschen müssen, sowohl am Anfang als auch am Ende. Dabei entstehen starke thematische Überschneidung, alsauch ist eine klare Abgrenzung der Tätigkeiten nicht möglich. Dieser Sachverhalt kann unter bestimmter Betrachtung alsDoppelbeauftragung interpretiert werden, was aber auszuschließen ist.
