Wenn der Zuschlag bereits wirksam erteilt worden ist, kann dieser nicht mehr vor der Vergabekammer angegriffen werden (§168 Abs.2 , S1 GWB)

Die Zuschlagserteilung ist möglich, 10 Kalendertage nach Absendung der Bekanntgabe der Vergabeentscheidung per Fax oder Email, bzw. 15 Kalendertage nach Absendung der Bekanntgabe der Vergabeentscheidung per Post. (§134 Abs. 2 GWB)

Die Zulässigkeit eines Nachprüfungsantrags setzt ferner voraus, das die geltend gemachten Vergabeverstöße innerhalb von 10 Kalendertagen nach Kenntnis bzw.

- soweit die Vergabeverstöße aus der Bekanntmachung oder den Vergabeunterlagen erkennbar sind

- Bis zum Ablauf der Teilnahme - bzw. Angebotsfrist gerügt wurden (§160 Abs. 3 S1 Nr. 1-3 GWB). Ein Nachprüfungsantrag ist ebenfalls unzulässig, soweit mehr als 15 Kalendertage nach Eingang der Mitteilung des AG, einer Rüge nicht abhelfen zu wollen vergangen sind ( §160 Abs. 3 S.1 Nr. 4 GWB). Des Weiteren wird auf die im §135 Abs. 2 GWB genannten Fristen verwiesen

LÄA 145-39 Die bestehende Gesamtplanung bzgl Stützwänden, Kreuzungsbauwerken und Hochwasserschutz muss erweitert werden, um eine einheitliche, funktionierende Gesamtplanung zu erlangen.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Diese Anzeige ersetzt diejenige aus 2022. Die Notwendigkeit zur Aufnahme der zusätzlichen Bauwerke in die Gesamtplanung entstand aus Zusagen zu Einwendungen aus der Offenlage, aus geänderter Umweltplanung, Berücksichtigung aktueller Grundwasserstände , sowie dem fortgeschrittenen Detaillierungsgrad der Entwurfsplanung. Diese zusätzlichen Bauwerke sind nicht Bestandteil des Hauptvertrages, siehe Anhang-2-2-82-Ingenieurbauwerke.Um einer vollständigen , genehmigungsfähigen Planunterlage gemäß Lph 3+4, wie diese im HV gefordert ist, gerecht zu werden, sind die zusätzlichen Bauwerke erforderlich. Die Objekt- und Tragwerksplanung der neuen Bauwerke ist notwendig, um eine in sich geschlossene und sinnvolle Gesamtplanung des PfA 8.2 zu ermöglichen. Durch die Erbringung der Leistungen durch den bereits beauftragten Generalplaner können Synergieeffekte genutzt werden, da die Objekt- und Tragswerksplanung dieser neuen Bauwerke erst die Gesamtplanung vervollständig
