Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. 3 - Es wurden verschiedene ad hoc Maßnahmen angeordnet, unter anderem musste ein alter Wagon am Aufstellort verschoben werden, sowie eine Leitplanke auf- und abgebaut werden, eine Mauer geöffnet werden, sowie zerstörte Tiefenentwässerung wieder hergestellt werden

Die Vergabe an einen anderen AN hätte zu erheblichem Zeitverzug geführt. Der Bauablauf wäre erheblich behindert gewesen.
