Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

VAuf Grund von betrieblichen Einschränkungen, Kampfmittelverdachtsflächen und technischen Unwägbarkeiten imBaubereich wurden sämtliche Arbeiten für den Sperrpausenzeitraum vom 23.09.2023 - 11.10.2023 abgesagt. Ausgenommenwaren hiervon die zusätzlich erforderlichen Kampfmittelsondierungsarbeiten. Eine Alternativlösung ist in Erstellung. Die Baustelleruht derzeit. Die Personal- und Gerätekosten während einer definierten Stillstandszeit sind dem AG anzulasten.Ein Wechsel des AN macht aus wirtschaftlichen Gründen keinen Sinn, weil der anvisierte geplante Bauablauf schon in einer sehrzeitkritischen Zeitschiene liegt. Das Risiko besteht, geplante Sperrpausen im GJ 2024 und die IBN der EÜ nicht einzuhalten.Mit Nutzung eines Alternativkonzeptes kann eine Bauzeitverlängerung möglicherweise verhindert werden und der Bauabschlusstermin- und vertragsgerecht erfolgen. Die oben eingestellten Kosten wurden AN-Bau-seitig geschätzt.
