Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Änderung der betrieblichen Rahmenbedingungen für die Planung des Streckenabschnitts Jena-West bis Jena-Göschwitz im

Projekt ABS Elektrifzierung Weimar-Gera-Gößnitz/Lehndorf in der Bautechnologie, Bauablauf- un Bauphasenplanung

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Mit Beginn der Entwurfs- und Genehmigungsplanungsleistung in 2021 war durch die Strategische Babetriebsplanung davon

auszugehen, dass der Streckenabschnitt Jena-Göschwitz zum Bf Jena-West mindesten eine Bahnsteigkannte bei der

Herstellung der Oberleitungsanlagen aufrecht zu erhalten ist. Im Zuge gemeinsamer Besprechung wurde im II Quartal 2023,

nach Rücksprache mit den beteiligten EVU die Thematik der Aufrechterhaltung einer Bahnsteigkannte besprochen und

erötrtert. Hieraus ergab sich, dass der Streckenbereich Jena-West bis Jena-Göschwitz in Totalsperrung ausgeführen und

parallel zum Realisierungsabschnitt Weimar - Jena-West umgestetzt werden kann. In diesem Zuge ist das bestehende

Bauphasenkonzept mit seinen einzelnen ESP, GWB und teilweiser ToT für diesen Abschnitt zu überabreiten. Demzufolge ist

dieser Abschnitt mit in die Betrachtung der Totalsperrung des Streckenabschnitt Bf Weimar bis Jena-West mit aufzunehmen

und entsprechend zu optimieren und zu beplanen.
