Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Gemäß den Vertragsunterlagen ist durch den AN ein Blindenleitsystem auf der SÜ Buckower Chaussee herzustellen. Die konkrete bauliche Ausbildung wurde in Abstimmung mit dem Senat nun festgelegt. Dies führt zu Änderungen im Aufbau der Kappe der SÜ und Mehraufwendungen zur Anpassung der Ausführungsplanung. Eine Veränderung des Gesamtcharakters des Vertrages ist nicht gegeben. Durch Wechsel des AN entsteht erheblich erhöhter Koordinierungsaufwand sowie zeitintensive

Neuvergabe und Einarbeitung zweiter AN.
