Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Gemäß Vertrag ist VP 2B mit der Herstellung der EÜ Säntisstraße inkl. neuer Zuwegung zur Hebeanlage beauftragt. Aufgrund des Sicherheitsbedürfnisses der BWB ist eine Umzäunung inkl. Torüberwachung zu errichten. Eine Veränderung des Gesamtcharakters des Vertrages ist nicht gegeben. Es ergeben sich Änderungen und zusätzliche Leistungen. Durch Wechsel des AN entsteht erheblich erhöhter Koordinierungsaufwand sowie zeitintensive Neuvergabe und Einarbeitung zweiter AN.
