Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Begründung für die o.g. zusätzlichen Leistungen wird nachfolgend erläutert:

Entgegen der Planfeststellung hat die Stadt Müllheim die Erschließung der Westseite mittels einer zusätzlichen barrierefreien Rampe gefordert, für den Fall, dass der Aufzug ausfällt. Im Nachtrag 20-04 wurde die "Neuplanung Rampe und Anpassung Parkplatz in den Lph 1-4" für Ingenierbauwerke, Tragwerksplanung sowie Verkehrsanlage Parkplatz beauftragt. Am 18.03.2022 wurden zusätzlich die Lph. 6+7 angeordnet.

Aus Sicherheitsgründen ist auch die Beleuchtung der Rampe notwendig, die in den genannten Nachträgen bzw. Anordnungen noch nicht beauftragt ist.

Entsprechend ist als zusätzliche Leistung die Planung der Beleuchtung in den Leistungsphasen 3, 6 und 7 für die Rampe West am Bf Müllheim erforderlich. Die Zeitschiene sieht die Fertigstellung der Leistungsphase 3+6 bis Ende Dezember 2023 vor.

Diese Planungsleistungen sind nicht Teil des Hauptauftrages oder bestehender Nachträge.

Der AN ist über den Nachtrag 20-04 bereits mit den Planungsleistungen für die Rampe West am Bf Müllheim beauftragt. Ebenso wurden bereits dem AN die Lph. 6 und 7 angeordnet. Der AN hat die Ortskenntnis und die gesamte bisherige Planung durchgeführt. Er ist sofort arbeitsfähig. Der Mehraufwand durch einen neuen AN ist wirtschaftlich unverhältnismäßig und würde technisch zu erheblichen Schwierigkeiten führen. Dazu gehören erheblichen Koordinationsprobleme, da die Leistungen zur Planung des Ingenierubauwerks der Rampe inklusive der Tragwerksplanung bereits im Auftrag des AN liegen. Da ein zweiter AN keinerlei Vorkenntnisse hätte und sich erst vollständig in die vorliegende Planung einarbeiten müsste, müsste dieser Einarbeitungsaufwand zusätzlich vergütet werden. Auch bei der Projektleitung würden dadurch erhebliche Mehraufwendungen entstehen (u.a. durch zusätzliche Besprechungen, etc.). Entsprechend würden durch den Wechsel des AN beträchtliche Synergieeffekte, die durch einheitliche Leistungsdurchführung und Leistungsbetreuung entstehen, verloren gehen.
