Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Anpassung der Honorarzonen zum HV aufgrund höherer, nicht vorhersehbarer Komplexität in der Planung. Einstufung der

Honorarzonen gem. den Bewertungsmerkmalen der Honorarzonen nach HOAI. Die Ergebnisse der vertieften Planung zeigte,

dass der Schwierigkeitsgrad in der Objekt- und Tragwerksplanung höher ist, als zum Zeitpunkt der Ausschreibung ermittelt.

Daher ist eine Anpassung der Honorarzone zum HV erforderlich.

Durch Anpassung der Honorarzonen bleibt der Gesamtcharakter des Auftrags unverändert.
