Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Inhalt des Ingenieurvertrags der INGE BÜW S13 ist mit Blick auf den vorliegenden Nachtrag u.a. die Bauüberwachung der Gleisanlagen im Bft. KFWH. Die provisorische Gleisanlage zu den Mannstaedtwerken (Pioniergleis) war im Vertrag der INGE BÜW nicht enthalten, wurde aber zur Bedienung der Mannstaedt-Werke in den Sperrpausen zusätzlich notwendig.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Leistung musste durch die INGE BÜW S13 überwacht werden, da es sich um dessen Baubereich/Baugleis handelte. Der Gesamtverantwortliche gemäß Betra war ebenfalls die INGE BÜW S13. Die Bauleistungen wurden durch das Los 5.001 durchgeführt. Diese werden vertraglich und terminlich durch die INGE BÜW S13 betreut. Eine zusätzliche Beauftragung hätte zur Folge, dass zwei AN Bauüberwachungsleistungen an einem Baubereich/Baugleis durchführen. Dies würde zu erheblichen Schwierigkeiten und gegenseitigen Behinderungen führen. Darüber hinaus wären grundsätzliche übergeordnete Leistungen doppelt erforderlich, sodass Zusatzkosten entstehen.
