         - Präqualifizierte Unternehmen führen den Nachweis der Eignung durch den Eintrag in einer Präqualifizierungsdatenbank (Präqualifikationsverzeichnis). Nicht präqualifizierte Unternehmen haben zum Nachweis der Eignung mit dem Angebot das ausgefüllte Formblatt 124 – Eigenerklärung zur Eignung (Vergabehandbuch des Bundes) – vorzulegen. In dem Formblatt sind Angaben zur Eintragung in Berufsregister, Insolvenzverfahren und Liquidation, schwere Verfehlungen, Zahlung von Steuern, Abgaben und Beiträgen zur Sozialversicherung, Angabe zur Mitgliedschaft bei der Berufsgenossenschaft zu machen. Das Formblatt ist Bestandteil der Vergabeunterlagen. Gelangt das Angebot in die engere Wahl, sind die Angaben in der Eigenerklärung zur Eignung auf gesondertes Verlangen durch die Vorlage entsprechender Bescheinigungen der zuständigen Stellen zu bestätigen. Dies gilt auch für eingesetzte Nachunternehmen. Bescheinigungen, die nicht in deutscher Sprache abgefasst sind, ist eine Übersetzung in die deutsche Sprache beizufügen. Eine einheitliche Europäische Eigenerklärung gemäß § 50 VgV wird akzeptiert.

         - Eigenerklärung und Vorlage einer Versicherungsbestätigung Betriebshaftpflicht (Deckungszusage und Deckungssumme) mit mind. 1 Mio. für Sach- und 3 Mio. für Personenschäden je Schadensfall und 2facher Schadenshöhe p.a. sowie einer Vermögensschadensversicherung über 500.000,- € oder Bestätigung des Versicherers, dass im Auftragsfall eine entsprechende Versicherung abgeschlossen wird..

         Bei der Abgabe des Angebotes hat der Bieter gemäß § 4 Abs. 1 Nieders. Tariftreue- und Vergabegesetz (NTVergG) schriftlich zu erklären, dass er seinen Arbeitnehmer/innen bei der Ausführung der Leistung mindestens ein Mindestentgelt nach den Vorgaben des Mindestlohngesetzes (derzeit 9,35 Euro) zahlt bzw. mindestens ein Mindestentgelt entsprechend der Vorgaben des Arbeitnehmer-Entsendegesetz (AEntG), des Arbeitnehmerüberlassungsgesetzes (AÜG), der auf Grundlage des AEntG oder AÜG erlassenen Rechtsverordnungen sowie aus einem auf Grundlage von § 5 des Tarifvertragsgesetzes (TVG) für allgemein verbindlich erklärten Tarifvertrag (§ 4 Abs. 1 Nr. 1 sowie §§ 5, 6 AentG - Bauhaupt- und Baunebengewerbe -) zahlt.
