Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Änderungen am Durchflussquerschnitt des Hammerbaches und Forderungen des WWA Münchens zur Nachweisführung

gleichbleibender Hochwassersituation zwischen Ist- und Soll-Zustand. Berechnung der Wasserspiegellagen für den IST- und

Planungszustand sind durchzuführen und ein Vergleich aufzustellen für den HQ100 Fall. Hierfür ist Anhand der

Vermessungsdaten ein hydraulisches Modell aufzustellen. Bereits in Nachtrag 01 dieses Vertrages sind auf Grund von

Querschnittsanpassungen an der EÜ Schwillach genau solche Berechnungen durchgeführt worden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Im Zuge der Planung der Sanierungsmaßname des Bauwerks EÜ Hammerbach mittels einzug eines Wellstahlrrohres in das

bestehende Bauwerk, kommt es zu einer Querschnittsveränderung. Die Gemeinde Walpertskirchen und das WWA-München

fordern deshalb eine eingehende Untersuchung der Hochwassersituation um eine Beeinträchtigung der Angrenzenden Bebauung

und Kläranlage zu vermeiden. Aus diesem Grund sind hydraulische Berechnungen und der Vergleich zwischen Ist-Zustand und

Planungszustand notwendig. Der Gutachter hat die bisherigen Planungen übergeben bekommen zur Erstellung des

hydrogeologischen Gutachtens und kennt die gesamten Planungen an der Strecke und die örtlichen Gegebenheiten. Es

entstehen somit synergie Effekte wodruch Einsparungen in der Einarbeitung des Gutachters entstehen. Von AG seite her wird

eine weitere Schnittstelle vermieden, womit Einsparungen in der Koordination der Schnittstelle erzielt werden.
