Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Gemäß dem geotechnischen Bericht, der im Rahmen der Maßnahme ESTW Landstuhl eingeholt wurde, sind mehrere Gründungen für Signalmasten und -Auslegern erforderlich. Hierbei handelt es sich um eine zusätzliche Leistung für den Bau-Auftragnehmer die so nicht im HV enthalten ist, jedoch zwingend notwendig, damit der Auftragnehmer seinen Werkerfolg herbeiführen kann. Durch die Beauftragung eines zweiten AN, wäre für den Auftraggeber nicht mehr hinreichend erkennbar, welchem AN gegenüber er ggf. Mängelansprüche geltend machen muss. Hierdurch würde die Zuordnung der Verantwortlichkeiten besonders erschwert, da die Nachtragsleistung, sich nicht als ein separates Leistungsbild darstellen lässt. Die Beauftragung eines anderen Auftragnehmers würde bedeuten, dass Beträchtliche Zusatzkosten entstehen, weil honorarmindernde Faktoren, wie z. B. Wiederholungsfaktoren bei einer getrennten Vergabe nicht in Ansatz gebracht werden können. Ein zweiter AN hätte sämtliche Grundkosten, wie BE-Fläche, Beweissicherung, diverse Messungen usw. zur kalkulieren.
