Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

BW 55b:

Die A94-Brücke in Riem ist nach Anforderung der Autobahn (05.07.2023) zu erneuern. Somit entfällt der 1-gl. Tunnel, der die

Strecke 5618 unterirdisch unter der A94 unterführen sollte. Nun wird die 5618 oberirdisch unter der neuen erweiterten Brücke

geführt. Östlich der 5618 wird ein Dienstweg angelegt. Dazwischen ist eine SW erforderlich, da das Schotterbett hochgezogen

werden muss, um eine Breite des Dienstweges von 5,00 m erreichen zu können.

BW 22:

Vom Nachbarprojekt "2. Stammstrecke München" wurde eine Zufahrt an der Engstelle zwischen Hüllgraben und Ladegleis 14

angefordert. Hierfür ist die Planung einer Stützwand zur Begrenzung der Hüllgrabenböschung erforderlich.

BW 23:

Es wurde erst in 2022 festgelegt, dass der südliche Verlauf des Hüllgrabens weiter zu beplanen ist. In diesem Zuge ist die

Planung einer SW zur Begrenzung der Hüllgrabenböschung vom zu errichtenden digitalen Stellwerk aus dem Nachbarprojekt

„Ausbau Bf. Trudering“ erforderlich geworden.
