Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Um den Bahnübergang für Radfahrer und Fußgänger während der Bauzeit durchgängig passierbar zu halten, muss ein

provisorischer Überweg gebaut und vorgehalten werden. In der Ausschreibung wurde dem AN allerdings nur das Vorhalten des

provisorischen Überweges mitgeteilt. Der Einsatz eines anderen Unternehmens mit einer seperaten Ausschreibung für

zusätzlichen Leistungen ist aus Termingründen nicht möglich. Die zusätzlichen Leistungen sind während des Bauablaufs

aufgetreten und eine Vergabe an einen anderen AN bedeutet erhebliche Verzögerungen im Bauablauf und somit Verzögerungen

im Projekt bedeuten. Die angemeldeten Sperrpausen könnten nicht genutzt werden, was mit einer erheblichen Kostensteigerung

einhergeht.
