Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Die Planung musste aufgrund von Erfordernissen der Deutschlandtaktmaßnahme angepasst werden, wodurch sich aufgrund

der Durchbindung der DK und TK in die zwei südlichsten Gleise (Gleis 21 und 22) diese sich weiter nach Süden verschieben.

Dadurch muss das Bauwerk EÜ Bahnhofstr./Erdinger Straße nicht nur, wie ursprünglich vorgesehen nördlich teilerneuert,

sondern auch südlich erneuert werden.

Zudem kommt der Wunsch der LHM einer barrierefreien und damit verlängerten Ausführung der Rampe (6% statt 8%), sowie

eine Aufweitung des Rahmens auf eine lichte Weite von 6,75m, statt wie im Bestand 4,0 m und einer lichten Höhe von 3,0 m

statt wie im Bestand 2,67 m. Hierdurch resultiert die Kompletterneuerung des Bauwerkes statt der ursprünglich vorgesehenen

Teilerneuerung die eine Neuplanung erfordert.
