Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Um den Umbau des Bahnübergangs in den vorhandenen Sperrpausen zu gewährleisten, mussten zusätzliche Nachtschichten

eingeplant werden. Zudem konnte die angedachte BE-Fläche nicht genutzt werden und der AN musste eine neue BE-Fläche

suchen und anmieten. Aufgrund des Abstands zur Oberleitung mussten bereits gesetzte Fundamente neu positioniert werden.

Beim Umbau der Schleppkurve wurden Bestandskabel gefunden, welche gesichert und tiefergelegt werden mussten.Der Einsatz

eines anderen Unternehmens mit einer seperaten Ausschreibung für zusätzlichen Leistungen ist aus Termingründen nicht

möglich. Die zusätzlichen Leistungen sind während des Bauablaufs aufgetreten und eine Vergabe an einen anderen AN bedeutet

erhebliche Verzögerungen im Bauablauf und somit Verzögerungen im Projekt bedeuten. Die angemeldeten Sperrpausen könnten

nicht genutzt werden, was mit einer erheblichen Kostensteigerung einhergeht.
