         - Aktueller Nachweis, dass der Bieter im Berufs- oder Handelsregister nach Maßgabe der Rechtsvorschriften des Landes der Gemeinschaft oder des Vertragsstaates des EWR Abkommens eingetragen ist, in dem er ansässig ist.

      2. Economic and financial standing:
         List and brief description of selection criteria:

         - Angabe zum Gesamtumsatz des Unternehmens in den vergangenen 3 Jahren (Mindestvoraussetzung: 2-facher Auftragswert bezogen auf das Los/die Lose, auf das/die sich der Bieter bewirbt.

         - Angaben zum Umsatz im Bereich des Ausschreibungsgegenstandes (Bereich Wasseranalytik) in den vergangenen 3 Jahren

         - Nachweis einer bestehenden Betriebshaftpflichtversicherung. Die Deckungssumme muss je Versicherungsfall das 1,5 - fache des Auftragswerts betragen. Ggf. ist eine Eigenerklärung, eine Betriebshaftpflichtversicherung in der geforderten Höhe im Auftragsfall abzuschließen, dem Angebot beizulegen.

         - Eigenerklärung zur Prüfung der Ausschlussgründe nach §§ 123 und 124 GWB

      3. Technical and professional ability:
         List and brief description of selection criteria:

         - Angabe von mindestens drei Referenzen mit vergleichbaren Aufträgen im Bereich der Wasseranalytik aus den Kalenderjahren 2021-2023 mit Benennung eines Ansprechpartners (mit Tel.-Nr.) beim damaligen Auftraggeber. Vergleichbar sind hier insbesondere Aufträge für wiederkehrende Beprobungen/Analysen aus den Be-reichen Abwasser, Trinkwasser, Gewässer - vorzugsweise in staatlichem Auftrag.

         Der Auftraggeber ist berechtigt, die angegebenen Referenzen selbst auf Richtigkeit zu überprüfen und bei den entsprechenden Ansprechpartnern Informationen über das Referenzprojekt einzuholen. Sollten sich dabei Tatsachen ergeben, die den Bieter als nicht geeignet darstellen, kann er vom weiteren Verfahren wegen mangelnder Eignung ausgeschlossen werden (siehe auch § 57 VgV i.V.m. Nr. 13.2.1 VwV Beschaffung).

         - Notifizierung als Untersuchungsstelle, die im gesetzlich geregelten Umweltbereich physikalisch-chemische und chemische Untersuchungen im Bereich Abwasser durchführt gemäß LAWA-AQS-Merkblatt A-1 vom 04.2022. Ein entsprechender Nachweis in Form eines von einer deutschen Notifizierungsstelle ausgestellten Notifizierungsbescheides ist vorzulegen.

         Sollte der Bieter zum Zeitpunkt der Angebotsabgabe nicht als Untersuchungsstelle, die im gesetzlich geregelten Umweltbereich physikalisch-chemische und chemische Untersuchungen im Bereich Abwasser durchführt, notifiziert sein, ist bei Vorliegen der Eignung eine Erklärung abzugeben, dass die im Rahmen der Notizifierung geprüften Voraussetzungen erfüllt werden. In diesem Fall ist ein entsprechender Notifizierungsbescheid bis zur Zuschlagserteilung nachzureichen. Der Erklärung ist ein Nachweis der Akkreditierung nach DIN EN ISO/IEC 17025 beizu-fügen.

         Läuft die bestehende Notifizierung während der Vertragslaufzeit ab, ist die erneute Notifizierung vor Ablauf der, dem Auftraggeber vorgelegten, Notifizierung nachzuweisen. Bei Ablauf der Gültigkeit einer Notifizierung geht die Vertragsgrundlage verloren, da die Eignungsanforderung nicht mehr erfüllt ist.
