Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Der zu untersuchende Bereich befindet sich direkt an der 1. Stammstrecke, einem sicherheitskritischen Umfeld. Beengte Platzverhältnisse, Zugverkehr bzw. Baustellenverkehr etc.. Die Bauüberwachung kennt sich in diesem Bereich bestens aus und kann auch unter den schwierigen dort vorherrschenden Bedingungen diese Art der Arbeiten aufgrund der bereits ausführlich vorhandenen Ortskenntnisse ausführen. Ein Wechsel des AN würde zu den vorgenannten sicherheitsrelevanten Aspekten zusätzliche Kosten hinsichtlich Sicherung, Einweisungen etc. verursachen, zudem muss mit weiteren Verzögerungen im Bauablauf gerechnet werden. Die detailliertere Auswertung der Untersuchungsergebnisse erlaubt eine Zuordnung der einen Untersuchungsparameter und somit eine gezieltere Wahl der Entsorgungsanlage. Letztendlich kann dies zur Reduzierung der Entsorgungskosten beitragen
