Der Auftragswert zur Bekanntmachung vergebener Aufträge (Formular 06 nach Richtlinie 2014/25/EU) wurde mit 1 EUR als fiktiver Wert aus Geheimhaltungsgründen angegeben, um den lauteren Wettbewerb zwischen Unternehmen nicht zu beeinträchtigen (zulässig gemäß SektVO §38, Absatz 6.4). Mit dieser Bekanntmachung einer Änderung (Formular 20 nach Richtlinie 2014/25/EU) wird nun der Auftragswert um einen vom Auftraggeber festgelegten Auf- oder Abschlag angegeben, um die Nachvollziehbarkeit als auch weiterhin den Geheimwettbewerb zu gewährleisten. Für die Änderung wird ebenfalls der Auf- bzw. Abschlag berücksichtigt. Dies gilt für VII) 1.6 und VII) 2.3.

Wir weisen darauf hin, dass die VO (EU) 2022/576 zur Änderung der VO (EU) Nr. 833/2014 Anwendung findet und Unternehmen, die den Sanktionsmaßnahmen in Art. 5k der VO (EU) 2022/576 unterfallen, aus dem Vergabeverfahren ausgeschlossen werden.

Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Aufgrund des Entfalls der Geschwindigkeitseinschränkung km 102 in BDKO und der damit einhergehende Anpassung des VzG 6135 (Jfpl 2024) ist das Geschwindigkeitsband ETCS anzupassen. Die beauftragte Leistung beinhaltet die Anpassung der Software in der ETCS-Z Selchow für den Bereich Doberlug-Kirchhain ob Bf. Abgesehen von den Projektierungs- und Montageleistungen ist zudem enthalten die firmenseitig abschließende Prüfung.

Das ETCS-Z Selchow inkl. der zugehörigen ETCS-Streckenausrüstung ist ein Produkt der Firma Siemens Mobility GmbH, weshalb die Software ausschließlich durch den Hersteller Siemens angepasst werden kann. Die Leistungen können sowohl aus technischen als auch aus wirtschaftlichen Gründen nur durch den AN vorgenommen werden.
