         Der Bieter hat im Formblatt „Bietererklärung“ namentlich eine Ansprechperson nebst Vertretung zu benennen.

         Ferner muss er in dem Vordruck Angaben zum Unternehmen und zum Umsatz machen.

         Ferner muss er Referenzen zu den in den letzten Jahren erbrachten Leistungen im Bereich der Energieversorgung in die Referenzliste eintragen. In die Referenzliste sind dazu mindestens 2 bereits abschließend durchgeführte Energielieferungen einzutragen.

         Soweit zutreffend, sind ferner Art und Umfang der Leistungen anzugeben, die der Bieter an Unterauftragnehmer übertragen will.

         Soweit zutreffend, sind ferner Angaben zu Arbeitsgemeinschaften / Bietergemeinschaften zu machen.

         Zum Nachweis der Zuverlässigkeit ist die Anzeige nach § 5 EnWG bzw. eine vergleichbare nationale Erklärung oder gleichwertig aussagekräftige Nachweise (z. B. Genehmigung nach § 3 EnWG bzw. eine vergleichbare nationale Erklärung) beizufügen. Zum Nachweis der Zuverlässigkeit ist, soweit keine Anzeige nach § 5 EnWG und / oder keine Genehmigung nach § 3 EnWG bzw. keine vergleichbaren nationalen Erklärungen vorliegen (z. B. bei sogenannten „Altversorgern“) alternativ zu den vorstehenden Ausführungen zu erklären, dass sie als sog. „Altversorger“ weder die Anzeige nach § 5 EnWG noch die Genehmigung nach § 3 EnWG benötigen.

         Alternativ dazu ist zum Nachweis der Zuverlässigkeit die Abgabe einer „Einheitlichen Europäische Eigenerklärung“ zulässig. Hierfür gelten die Vorgaben der Durchführungsverordnung (EU) 2016/7 der Kommission vom 5. Januar 2016 zur Einführung des Standardformulars für die Einheitliche Europäische Eigenerklärung.

         Zum Nachweis der Zuverlässigkeit ist ferner zu erklären, dass die Regulierungsbehörde dem Bieter gemäß § 5 EnWG die Ausübung der Tätigkeit weder ganz oder teilweise untersagt hat und Bedenken, dass die personelle, technische oder wirtschaftliche Leistungsfähigkeit oder Zuverlässigkeit nicht gewährleistet ist, sind seitens der Regulierungsbehörde bislang nicht angemeldet worden sind.

         Ferner ist zu erklären, dass sich der Bieter an keinerlei kartellrechtswidrigen oder wettbewerbsbeschränkenden Abreden oder Handlungen beteiligt hat und dass keinerlei Änderungen an den Ausschreibungsunterlagen vorgenommen wurden.

         Ferner ist eine Eigenerklärung zur Sicherstellung der Lieferungen im Rahmen der Bietererklärungen abgeben, dass sich der Bieter vor Beginn des jeweiligen Lieferjahres mindestens 75 % der Referenzmenge durch Lieferkontrakte mit Vorlieferanten / Erzeugern sichert.

         Wegen näherer Einzelheiten wird auf die Leistungsbeschreibung nebst Anlagen verwiesen.

         Hinweis: Sollten einzureichende Unterlagen (Nachweise / Erklärungen u. ä.) bei Angebotsabgabe fehlen, behält sich die Vergabestelle vor, diese kurzfristig am Tage der Angebotsabgabe nachzufordern. Soweit eine Nachforderung erforderlich sein sollte, müssen die fehlenden Unterlagen / Erklärungen innerhalb von 4 Stunden nach Anforderung per E-Mail oder Fax nachgereicht werden.
