Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Nachdem die Genehmigungsplanung (GP) der KIB-Bauwerke von AN im Jahr 2018 im Rahmen des

Planfeststellungsverfahrens im PFA 3.2 bereits erstellt und übergeben wurde, wurde im Jahr 2021 festgestellt, dass sich die

Planungsrandbedingungen geändert haben und anhand dessen die bereits erstellte GP angepasst werden muss.

Die Umstände, die zu Beginn der Vergabe seitens des AG nicht vorsehbar waren, sind, dass nach der Erstellung der

ursprünglichen GP sich die Planungsrandbedingungen geändert und sich weitere aktualisierte Planungsgrundlagen und

Anforderungen der Stadt Duisburg ergeben haben. Anhand der geänderten Randbedingungen und Grundlagen muss die GP

angepasst und erneut erstellt werden, um beim Eisenbahnbundesamt erneut im Rahmen des Deckblattverfahrens

einzureichen.
