Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Das ausgeschriebene Steuerkabel entspricht nicht den Vorgaben für die S-Bahn HH und der Querschnitt für die Hilfsspannungsversorgung ist abhängig von der erforderlichen Kabellänge. Durch die umliegende Fernbahnstrecke entstehen hohe Wechselspannungsströme die Auswirkungen auf die Steuerkabel haben, daher muss der Kabeltyp mit einem Schirm ausgeführt werden.

Die Kabel für die Hilfsspannungsversorgung ergeben sich aus der Fachplanung, da Länge, Querschnitt und Typ hierbei Auswirkungen auf die Ausführung haben.

Der AN ist für die gesamthafte Verlegung der Bahnstrom-Kabel für den Bauzustand gebunden und damit geht eine Abhängigkeit zu den zusätzlichen erforderlichen Steuerkabeln einher. Die Verlegung der Steuerkabel hat eine technische Abhängigkeit zu anderen zu verlegenden Kabeln durch den AN.

Bei Beauftragung eines weiteren AN, der zusätzliche Steuerkabel bestellt und verlegt, würde es zu einem nicht koordinierbarem Abstimmungsaufwand zwischen Fa. BBL und dem AN kommen. Durch die Einarbeitung in die Maßnahme, die Einbindung von Personal und Gerätschaften sowie den erheblichen Koordinationsaufwand ist ein Wechsel des AN mit nicht absehbaren Zusatzkosten verbunden.
