Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Die Notwendigkeit der Klimatisierung der FIZ / BAS Schränke in der Konstablerwache und Hauptwache wurde durch die Temperaturmessungen im Sommer 2022 festgestellt. Die Nachrüstung der Klimageräte soll die technische Funktionsfähigkeit von Komponenten der Brandmeldeanlage erhalten. Diese ist sei­tens des Herstellers nur bis 45 °C gewährleistet. Mit Schreiben vom 29.06.2023 über die Anlagenbezogene eigene Überwachung und der Feststellung des EBA, Frau Pankotsch, wurde der Betreiber aufgefordert, einen Termin zu benennen, bis wann die Klima-Gräte auf den SAS-Schränken in Betrieb gehen werden. Dem EBA wurde am 20.07.2023 von DB Station & Services AG (Hr. Wulf, Hr. Pehlivan) mittgeteilt, das durch die Firma Bosch voraussichtlich bis Ende der Kalenderwoche 32 die Montage und Inbetriebset­zung der Klimageräte erfolgen wird
