Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

MKA10: Während des Projektverlaufs wurde festgelegt, dass mehr ISO-Stöße als geplant rückgebaut werden müssen. Für die

Restarbeiten der ISO-Stöße waren zuvor nicht ausreichend Sperrpausen vorhanden, weshalb nun zusätzliche Schichten der

leitenden Bauüberwachung und Schweißüberwachung notwendig werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Arbeit steht in direktem Zusammenhang mit dem Inhalt des Hauptvertrages des AN, sodass die Beauftragung einer

separaten Firma somit nicht umgesetzt werden konnte. Der Wechsel des AN"s bzw. eine separate Ausschreibung für die

aufgeführten Leistungen war wegen der zusätzlichen Planung aus zeitlichen Gründen nicht möglich und hätte somit

Schwierigkeiten sowie erhebliche Zusatzkosten zur Folge.
