Im Zuge des erweiterten Bodenaushubs sind ergänzende Arbeiten notwendig geworden. Aufgrund von in die Baugrube einströmenden Wassers musste eine drainierende Schicht eingebaut werden.

Des Weiteren wurde die Ertüchtigung der Baustraße notwendig, um für eine verbesserte Nutzbarkeit zu sorgen erfolgte die Begradigung und Ertüchtigung der Baustraße.

Die zusätzlich erforderlichen Leistungen sind somit aufgrund von Umständen erforderlich geworden, die der öffentliche Auftraggeber im Rahmen seiner Sorgfaltspflicht nicht vorhersehen konnte (hier: im Detail abweichende tatsächliche Ausbreitung der festgestellten Bodenkontamination und damit einhergehend der unvorhersehbare Zustand des durchwässerten Bodens). Durch die notwendige Änderung wird der Gesamtcharakter des Auftrags jedoch nicht verändert.
