Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

48 - Die Leistungen des Änderungsanzeige umfasst erforderliche zusätzliche Leistungen für die Aktualisierung der Bestandsdokumentation der Stellwerke Milbertshofen und Freimann in DB AVANI, die durch Einführung von zusätzlichen Pflichtfeldern durch das verantwortliche Datenmanagements der DB Netz AG im Geodaten-Infrastruktursytem DB AVANI verursachtet wurde.

Die dargestellten Leistungen stellen zusätzliche Leistungen dar.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

48 - Die zusätzlichen Bauleistungen bauen vollständig auf bereits erbrachte und zu erbringende Leistungen der Fa. Duensing auf. Der Einsatz eines anderen Unternehmers für die zusätzlichen Bauleistungen wären mit erheblichen Schwierigkeiten und rechtlichen Fragen auf Gewährleistung für die aktualisierte Bestandsdokumentation in DB AVANI verbunden.
