Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nature and extent of the modifications (with indication of possible earlier changes to the contract):

21 - Aufgrund eines durch Dritte verursachten Kabelschadens und Beschädigung einer unterirdischen Kabelquerung bei der

Durchführung von Rammarbeiten, wird der AN gebeten, behelfsmäßig eine Stahlrohrquerung im Untergrund in leicht versetzter

Lage zu verlegen und anschließend eine Gleislagemessung durchzuführen. Die durch die Rammung beschädigten Kabel wurden

behelfsmäßig geflickt und müssen zu einem späteren Zeitpunkt in die neue Kabelquerung umverlegt werden.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

21 - Die Leistung war erforderlich und dringlich geboten, um die Gelegenheit des ohnehin ausgebauten Gleises 5540-1 zu nutzen

und damit den Kosten- und Zeitaufwand einer späteren Baustelle zum Ersatz der beschädigten Querung zu minimieren.
