Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Die Begründung für die o.g. zusätzlichen Leistungen wird nachfolgend erläutert:

Die Personenunterführung im Bf Müllheim wird Ende des Jahres 2023 in Betrieb genommen. Der Treppenabgang zur PU befindet sich im Empfangsbereich des Bahnhofes. Am Treppenabgang wurden zwei Beleuchtungsbügel geplant, um die Sicherheit der Fahrgäste in diesem Bereich zu gewährleisten, solange das Empfangsgebäude mit der Beleuchtung der Überdachung noch nicht in Betrieb ist. Zwischen den Inbetriebnahmen der Personenunterführung und des gesamten Empfangsbereiches liegt ein Zeitraum von ca. 2 Jahren. Die Beleuchtungsbügel bleiben auch nach der Inbetriebnahme des Empfangsgebäude erhalten.

Um gewährleisten zu können, dass die Beleuchtungsbügel in die noch zu erstellende Planung der Beleuchtung der Überdachung des EG integriert werden, ist als zusätzliche Leistung die Erstellung eines Beleuchtungskonzeptes für die Gesamtanlage der Überdachung unter Berücksichtigung der Beleuchtungsbügel am Treppenabgang zur PU erforderlich. Die Planungsleistung soll mit Anwendung der BIM-Methodik erbracht werden.

Diese erforderliche zusätzliche Leistung hat sich erst mit dem Planungsfortschritt für die Personenunterführung am Bf Müllheim ergeben und war weder zum Zeitpunkt der Beauftragung des Hauptauftrages noch des Nachtrages 22-14 zur Planung des Empfangsgebäudes bekannt.

Die Zeitschiene sieht die Fertigstellung des Beleuchtungskonzeptes bis Ende September 2023 vor.
