Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Der zu überwachende Leistungsumfang umfasst die Umverlegung/Neubau einer TK-Kabelanlage im Bereich der Bestandsstrecke als Teil der Baufeldfreimachung. Weiterhin sind die für das ESTW erforderlichen TK-Anlagen (ÜT, DBMAS, EMA/BMA, Kabelanlagen) zu überwachen

MKA01: Zusätzliche Bauüberwachungsleistungen TK

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Aufgrund Änderungen in der Bauausführung sind zusätzliche TK-Bauleistungen erforderlich. TK-Kabel müssen mit einem Überspannungsschutz ausgerüstet werden. Verlegung zusätzlicher Meldekabel für die Überwachung der TK, LST und 50 Hz -Anlagen. Die Fdl Arbeitsplätze sind mit einem zusätzlichen Überspannungsschutz und Ringsammelerder für TK-Kabel auszurüsten. Es sind zusätzliche LWL-Kabel umzulegen / zu verlegen. Zusätzliche Koordinationsleistungen aufgrund Umschaltung der Kabelanlagen unter Betrieb. Zusätzliche Bauzwischenzustände. Zusätzliche Abnahmen.

Für diese zusätzlichen Leistungen ist die TK-Bauüberwachung durchzuführen.

Die Bauüberwachung des AN der TK-Anlagen ist aufgrund der Terminverschiebungen / Qualifikation des AN umfangreicher als ursprünglich geplant.

Die Bauüberwachung der TK-Anlagen wurde bisher durch die Firma GTU Mobility durchgeführt.

Eine Bauüberwachung ein und desselben Gewerkes durch 2 unterschiedliche Bauüberwachende Firmen ist entsprechend Bau-STE nicht zulässig.
