Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Die unterschiedlichen Fertigstellungszeitpunkte der verschiedenen Fachgewerke (50 Hz, MTA, OLA. KIB) in Bezug auf die Bahnsteiganlagen verursachten Schwierigkeiten für eine koordinierte, fachgerechte und sicherheitstechnisch korrekte Ausführung der Erdung der jeweiligen Bauwerke/Bauteile. Als Voraussetzung für die Innutzungnahme wurden durch den Abnahmeprüfer zusätzliche Anpassungen bei der Erdung der Aufzugseinhausungen und einem OLA-Mast im Bahnsteigbereich gefordert.

Diese Leistungen haben sich erst im Rahmen der Abnahme der Bahnerdung ergeben, waren im Rahmen der Entwurfsplanung nicht vorhersehbar und konnten im Hauptvertrag nicht berücksichtigt werden: Anpassung der Erdung auf Belange des Abnahmeprüfers
