Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Ursprünglich war vorgesehen, dass zwischen Aachen Rothe Erde und Aachen Hbf die vorhandene Bestandskabeltrasse im

Rahmen des Projektes ABS4 Abschnitt Aachen Rothe Erde genutzt werden kann. Da diese jedoch zum Zeitpunkt der

Ausführung keine ausreichenden Kapazitäten beinhaltet hat (veränderter Zustand gegenüber der Entwurfsplanung), mussten

umfangreiche Kabeltiefbauarbeiten im entsprechenden Streckenabschnitt ausgeführt werden. Vor diesem Hintergrund wurden

umfangreiche Sperrpausen benötigt, die aufgrund verschiedener Sperrabschnitte und betrieblicher Belange in

unregelmäßigen Zeiträumen realisiert werden konnten. Für die Sperrpause im Februar 2022 mussten die Gerätschaften wie

Zweiwegebagger, Bahnwagen und Radlader an- und wieder abtransportiert werden, da diese nur im Rahmen dieser

Sperrpause benötigt wurden. Im Rahmen der Entwurfsplanung war dieser Sachverhalt unvorhersehbar und konnte somit nicht

im Hauptvertrag erfasst werden.
