Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. 6 - Die Sicherung fand, auf Grundlage von Vorabstimmungen mit der für den Bahnbetrieb zuständigen Stelle,

durch eine feste Absperrung sowie Sicherungsaufsichtskräfte und Absperrposten statt. Im Nachtrag macht der AN die Kosten für

den zusätzlichen Einsatz von Helfern im Bahnbetrieb geltend.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Im Rahmen der Bauausführung Bauausführung wurde bekannt dass eine HOA im Bereich der Baumaßnahme umfahren wird. Diese Umfahrung

macht eine technische Ortung von Heißläufern unmöglich. Daher war als Sicherungsmaßnahme der Einsatz von Helfern im Bahnbetrieb

notwendig. Lage und Vorkommen der HOA im Baubereich waren unbekannt. Weder in der Mitzeichnung noch in allen der Bauausführung

vorangehenden Planungsphasen und baubetrieblichen Anmeldungen wurde die HOA erkannt. Die Änderung waren trotz Sorgfalt nicht vorhersehbar. Der Gesamtcharakter des Auftrags bleibt unverändert.
