Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Im Rahmen der Ausführung von Kabelarbeiten und in Vorbereitung auf die IBN SPP im Juli 2023 ist zur Herstellung der Kabelanlage für den BZ1 eine Kabelführung zwischen km65,090 und km65,350 bahnlinks erforderlich. Da erst mit Anschwenkung des Gleises 113 in der IBN SPP der Kabeltrog im Endzustand hergestellt werden kann, jedoch die Kabelanlage aus LST-Sicht vor der IBN SPP vorbereitet werden muss, damit diese im Rahmen der IBN SPP angeschlossen und geprüft werden können, ist es notwendig die Kabel vorzeitig zu verlegen und eine provisorische Kabelsicherung durch Kunststofftrog im beschriebenem Abschnitt herzustellen.

Diese zusätzliche Leistung in Bezug auf die Erstellung eines provisorischen Kunststoffkanals hat sich im Rahmen der detaillierten

Ausführungsplanung ergeben, war im Rahmen der Entwurfsplanung

nicht vorhersehbar und konnte im Hauptvertrag nicht berücksichtigt

werden.
