Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. VII.2.1)Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
MKA172: Ausrüstung 50 Hz BSH 507
Das BSH 507 wurde als zusätzlicher Kabelstützpunkt für LST Kabel neben dem ESTW und RSTW Gelnhausen durch die Fa. Leonhard Weis errichtet.
Das BSH 507 muss mit Stromversorgung für die Steckdosen und die Beleuchtung ausgerüstet werden. Die Ausrüstung des BSH 507 mit einer 50Hz Anlage war nicht im LV enthalten.
Die Hausinstallation, die Unterverteilung, die Kabel, die Erdungsanlage sowie die Erstellung von Messprotokollen, die Inbetriebnahme und die Abnahme sind somit zusätzliche Leistungen.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
Die Lieferung und Montage des BSH 507 erfolgte bereits hauptvertraglich durch den AN. Der AN schuldet den Gesamtwerkerfolg. Zur Herstellung der Nutzbarkeit des BSH 507 ist auch die Ausstattung mit der notwendigen TGA notwendig. Somit ist die Ausrüstung der TGA zur Erreichung des geschuldeten Werkerfolgs notwendig und vom AN zu erbringen. Die Lieferung und Montage des BSH 507 erfolgte bereits hauptvertraglich durch den AN. Der AN schuldet den Gesamtwerkerfolg. Zur Herstellung der Nutzbarkeit des BSH 507 ist auch die Ausstattung mit der notwendigen TGA notwendig. Somit ist die Ausrüstung der TGA zur Erreichung des geschuldeten Werkerfolgs notwendig und vom AN zu erbringen.
