Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below

The procurement falls outside the scope of application of the directive

Explanation:

In the case of the other potential suppliers, the development of the product has not yet reached a sufficient level of market maturity or the development in accordance with TenneT"s requirements has not even begun, and therefore does not represent a technical alternative. With reference to the extremely urgency, a fact according to § 13 para. 2 no. 4 SektVO is given. The development time of the required equipment is more than one year. On the other hand, the demand for the three projects mentioned above is already starting in the third quarter of 2023. This period is by far not sufficient for an extensive negotiation procedure with a prior call for competition and, in addition to that, the necessary development activities of the potential suppliers. A later award (the duration of the award process was estimated by TenneT in this case to be approximately 9 months) would increase the time risks of the project or the operational constraints to such an extent that an EU award would no longer be sustainable and proportionate. Against the background of the development plans of the potential manufacturers and the associated necessary development periods, there is also the circumstance that the extreme urgency is not to be attributed to TenneT, but to the contractor.

Taking into account the above, it is possible under procurement law for TenneT to conduct a negotiated procedure without prior call for competition with only two bidders. This negotiation is documented on the tender platform Negometrix. TenneT has examined and taken into account the restrictions of Section 135 GWB on ineffectiveness. The scope of Section 135 para. 1 no. 1 GWB is not applicable, a permission to award the contract pursuant to Section 135 para. 3 GWB exists according to the above findings.
