Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Nach Aussage des ANs ist gem Gemäß HLV-Pos. 07.02.0150 ist die bestehende Rohrgründung aus Stahl / Eisenrohr mit dem

Durchmesser ca. 170 mm bis ca. 1,0 m unter GOK freizulegen und auszubauen. Gemäß Bauwerksplan A10-300-3-LP-000-BW_03 ist das „vorh. Ramm Rohr als Gründung in künftiger Fundamenttiefe auzubauen. Beim Freilegen der Fundamentfüße wurde festgestellt, dass das Ramm Rohr noch zusätzlich mit einem gemauerten Fundament umgeben ist. Dieses Fundament musste zusätzlich vor dem Ausbau der Stützen und dem Rückbau der Gründung abgebrochen werden. Diese Leistungen sind nicht Bestandsteil der Beauftragung, demzufolge sind diese Leistungen dem Grunde nach berechtigt. Nach Aussage der BÜW sei die NT Kalkulation jedoch "aufgeblasen" und die Stahlrohr Rundung sei in einem Schritt herausgezogen worden.
