         Nachweis der Eintragung in ein Berufs-/Handelsregister, sofern eine Eintragungspflicht besteht. Besteht keine Eintragungspflicht, genügt ein schriftlicher Hinweis / Eigenerklärung.

      2. Economic and financial standing:

         - Aktueller Nachweis einer Betriebs-/Berufshaftpflichtversicherung mit Angabe der Versicherungshöhe und einer Erklärung, dass diese bei Abgabe des Angebotes nicht gekündigt ist. Im Falle, dass der Bieter über keinen aktuellen Nachweis einer Be-triebs-/Berufshaftpflichtversicherung verfügt, hat der Bieter eine Eigenerklärung abzugeben, dass im Auftragsfalle vor Zuschlagserteilung eine entsprechende Versicherung abgeschlossen wird. Der Nachweis über die abgeschlossene Versicherung ist zu dem von der Vergabestelle/dem Auftraggeber geforderten Zeitpunkt vorzulegen

         List and brief description of selection criteria:

         - Die berufliche Leistungsfähigkeit ist durch Referenzen über früher ausgeführte Dienstleistungsaufträge in Form einer Liste (Anlage 10) der in den letzten 3 abgeschlossenen Jahren (2020 bis 2022) erbrachten wesentlichen Dienstleistungen, die mit der zu vergebenden Leistung vergleichbar sind nachzuweisen. Insbesondere sind hier Referenzen mit Angabe des Projektnamens und Kurzbeschreibung der Leistung, Auftragswert, Bearbeitungszeit-raum sowie den Namen des Auftraggebers zu nennen (soweit diesen Informationen keine Geheimhaltungsprinzipien entgegenstehen).

         - Unterauftragnehmer:

         Angaben des Bieters, welche Teile des Auftrags das Unternehmen / der Bieter unter Um-ständen als Unteraufträge zu vergeben beabsichtigt (Anlage 1).

         - Hinweis zur Tariftreue- oder Mindestentgelterklärung:

         Gemäß dem Landestariftreue- und Mindestlohngesetz (LTMG) dürfen öffentliche Auftraggeber in Baden-Württemberg Aufträge ab einem geschätzten Auftragswert von 20.000 EUR (netto) nur an Unternehmen vergeben, die bei der Angebotsabgabe eine schriftliche Tariftreue- oder Mindestentgelterklärung abgegeben haben. Die Verpflichtungserklärungen sind den Vergabeunterlagen als Anlage 5 beigefügt.

         Das LTMG, die Besonderen Vertragsbedingungen der LUBW zur Erfüllung des LTMG und das Merkblatt für die Abgabe der Verpflichtungserklärung können bei Bedarf bei der LUBW angefordert oder im Internet unter www.lubw.baden-wuerttemberg.de (Geschäftsbedingungen) eingesehen werden.

         Dem Angebot ist die auf das Unternehmen/den Bieter zutreffende unterschriebene Erklärung hinzuzufügen.

         Die Verpflichtungserklärungen sind auch für Nachunternehmen und Verleihunternehmen vorzulegen, sofern der Auftragswert, den das Nachunternehmen oder Verleihunternehmen erbringt, 10.000 EUR (netto) übersteigt.

         - Einhaltung der geltenden rechtlichen Verpflichtungen:

         Dem Angebot ist die Eigenerklärung über die Einhaltung rechtlicher Verpflichtungen (Anlage 6) bei der Ausführung des öffentlichen Auftrags hinzuzufügen.

         - Technische und organisatorische Maßnahmen zur DS-GVO:

         Im Falle der Zuschlagserteilung ist mit dem Auftraggeber der Auftragsverarbeitungsvertrag (Art. 28 Abs. 3 DS-GVO) gemäß Anlage 8 abzuschließen.

         Die technischen und organisatorischen Maßnahmen i. S. d. DS-GVO müssen, von dem Bieter an den der Auftrag vergeben werden soll, vor der Zuschlagserteilung nach Aufforde-rung durch den Auftraggeber innerhalb von 5 Kalendertagen an diesen übermittelt werden. Erfolgt keine Übermittlung der technischen und organisatorischen Maßnahmen zur DS-GVO behält sich der Auftraggeber in diesem Falle die Geltendmachung von Schadener-satzansprüchen, z.B. in Form von Preisdifferenzen, vor.

         Der Bieter kann die technischen und organisatorischen Maßnahmen i. S. d. DS-GVO auch freiwillig gleichzeitig mit der Abgabe seines Angebots einreichen.
