Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Im Rahmen der Vorplanung für die ABS Leipzig - Chemnitz Südabschnitt wurde festgestellt, dass weitere KIB-Bauwerke einer Anpassung/Umbaus unterzogen werden müssen, um das Projektziel Elektrifizierung und Herstellung Zweigleisigkeit zu erreichen. Diese Bauwerke waren nicht explizit in der zu kalkulierenden Bauwerksliste des Hauptvertrages (Ermittlung der Vergütung) enthalten. Weiterhin waren für die meisten KIB-Bauwerke nur die Leistungen nach HOAI § 44 und 52 ausgeschrieben. Der straßenbauliche Anpassungsbereich gemäß HOAI § 47 wurde nicht betrachtet und wird bei Bauwerken mit großen Straßenanteil ergänzend mit diesem Nachtrag ausgewiesen.

Die ARGE GRE - Schulze&Rank ist bereits mit der Erstellung der Grundlagenermittlung und Vorplanung (Lph.1-2) beauftragt. Planunterlagen und Dokumente dieser Vorplanung sind Grundlage und Voraussetzung für die Beplanung der zusätzlichen Objekte in dem gesamten Planungsabschnitt. Ein weiterer AN führt zu einem unwirtschaftlichen Mehr- und Koordinierungsaufwand. Eine Trennung der Leistungen ist nicht möglich, da die Erstellung der zusätzlichen Planung der Objekte auf Leistungen bzw. Planung der Leistungsphase 1 und 2 der ARGE aufsetzt. Mit AN-Wechsel kommt es zu signifikanten Verzögerungen im Zeitplan und es stehen sich die gesonderte Wertung und Vertragsabwicklung des neuen AN, mit einem unverhältnismäßigen zusätzlichen Aufwand, im Vergleich zur Gesamtleistung der ARGE GRE - Schulze&Rank gegenüber (unwirtschaftliche Splitterung).
