Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

MKA 75: bezieht sich auf die zusätzliche Leistung, die der AG (ALV LST im Jahr2021) angeordnet hat.

Dies war für die Sicherheit im Bahnbetrieb nach dem Umbau erforderlich.

Die Anordnung der Leistung erfolgte nachträglich durch die PL am 10.09.2021.

Aufgrund der Erneuerung des Mittelbahnsteiges 2 wird der Bahnsteig zu Gleis 5 nicht

mehr benötigt. Dies führte dazu, dass das Fundament des Signals LS5 nach dem Umbau nicht mehr

im befestigten Bereich stand und die Standsicherheit während der notwendigen

Arbeiten am Signal nicht gegeben war. Die Leistung ist dem Grunde nach anzuerkennen.
