Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. VII.2.1)Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

2 - Die Erstellung der Entwurfsplanung wird vom laufenden Prozess der Baubetriebsplanung begleitet. Dies beinhaltet die

Abstimmung mit dem Baubetrieb, sowie die Prüfung der Rückmeldungen des Baubetriebs. Dabei ist je nach Rückmeldung durch

den Baubetrieb eine Prüfung, Fortschreibung, Abstimmung und Überarbeitung des Bauablaufs und weiterer betroffener

Dokumente erforderlich.

Weiterhin wird auf Anforderung des Netz Augsburgs, der Projektbereich um die Auflösung des Querfeldes 7-25/7-26 im Bf.

Westheim erweitert. Hier ist die Entwurfsplanung, Abstimmung und Prüfung der Umsetzung eines Masttausches 7-25 erforderlich.

Ohne die zu erbringenden zusätzlichen Leistungen ist die Erstellung der Entwurfsplanung nicht möglich.

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die erforderlichen zusätzlichen Leistungen sind unmittelbar mit der Oberleitungsplanung verknüpft, sodass nur durch eine

gesamtheitliche Betrachtung ein schlüssiges und technisch sinnvolles Konzept ausgearbeitet werden kann. Durch die

Notwendigkeit des Zugriffs auf eine einheitliche Planungsgrundlage, ergibt sich daher eine zusätzliche Schnittstelle, die von der

arbeitstechnischen Koordination schwierig umzusetzen ist und zu unverhältnismäßigen Mehraufwand führen würde:

- Koordination zwischen mehreren Planungsfirmen

- Einbinden eines zusätzlichen Planers ins Projekt

- ggf. zusätzliche Begehungen inkl. zusätzlichen Kosten
