Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Ein Wechsel des AN ist nicht möglich, da die zusätzlichen Leistungen unmittelbar in die zu erbringenden Leistungen eingreifen und ein Wechsel des AN nicht ohne erheblichen Einarbeitungsaufwand möglich ist (finanzielle Auswirkung) und auch hinsichtlich der Vollständigkeit der Leistungen nicht trennbar sind. Die Leistung ist auf Grund nicht abschätzbarer Wirkungen in die planerische Verantwortung des bisherigen AN nicht am Markt platzierbar. Ein Wechsel des AN würde den Projektfortschritt verzögern, wodurch erhebliche wirtschaftliche Schäden entstehen. Durch das Einarbeiten eines neuen AN würden zusätzliche Kosten entstehen.
