Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nachtrag 42.3: Abschaltung Druckluft bei Brandalarm FHAU

VII.2.2)Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Im Rahmen der Abnahmeprüfungen der BMA-Hauptwache wurde durch den EBA-Abnahmeprüfer bemängelt, dass im Brandfall eine Abschaltung der Ausblaseinrichtungen der Ansaugrauchmelder (3-Wegeventile) der RAS-Anlagen umzusetzen ist. Die Abschaltung der funktionalen Kette vom auslösen-den Melder bis zu den angesteuerten 3-Wegeventilen ist nachzuweisen.

Darüber hinaus muss sichergestellt werden, dass auch Störungen der Druckluftanlagen dem Betreiber DB Station & Service AG-Bahnhofsmanagement Frankfurt mittzuteilen sind, damit über den Dienstleister umgehend eine Störungsbeseitigung erfolgt.

Derartige Vorkommnisse werden über die Gebäudeautomation erkannt und weitergeleitet.

Da es noch keine Gebäudeautomation der Anlagen der DB in der uPVA-Konstablerwache gibt, sind die Störungen und Ausfälle von Druckluftanlagen über geeignete logische Bauteile festzustellen und auf eine ständig besetzte Stelle (3-S Zentrale) weiterzuleiten sowie auf dem Störmeldertableau vor Ort in der Brandmeldezentrale anzuzeigen.

In Rahmen der Wirkprinzipprüfung (1:1 Test) der Brandfallmatrix mit allen Komponenten ist auch die Funktionsfähigkeit der Abschaltung der Freiblaseinrichtungen der RAS Anlagen in der Konstablerwache nachzuweisen sowie die uneingeschränkte Funktionssicherheit der Drucklufttechnik ständig zu gewährleisten.
