Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Neustrukturierung der Bauphasen im Zuge der Entwurfsplanung (LPH 3) im Bereich des Bf Freilassing gegenüber dem Bauphasenkonzept der Vorplanung (VP) infolge geänderter Vorgaben seitens des Betriebs, sowie der Optimierung der Trassierung. Dadurch wird die Realisierbarkeit der neu entstandenen Projektschnittstelle sichergestellt.

Im Zuge der Entwurfsplanungen haben sich gegenüber den Vorplanungen Änderungen ergeben, die ergänzende Planungsleistungen erforderlich machen.
