Nach der Eignungsprüfung werden max. drei Unternehmen zur Abgabe eines Erstangebotes aufgefordert.
Die Unternehmen erhalten sodann Gelegenheit zur Angebotspräsentation.
Auf der Grundlage der Erstangebote wird dann anhand der Zuschlagskriterien ein bevorzugter Bieter ausgewählt.
Mit diesem wird dann das Angebot endverhandelt.
Der bevorzugte Bieter erhält - sollte er ein zuschlagsfähiges Angebot abgeben und dennoch keinen Zuschlag erhalten für seine weitere Angebotsbearbeitung eine Kompensation in Höhe von 20.000 EUR zzgl. USt. Diese wird im Zuschlagsfalle mit der vereinbarten Werklohn verrechnet und gilt damit als abgegolten.

Genaue Angaben zu den Fristen für die Einlegung von Rechtsbehelfen:
(1) Etwaige Vergabeverstöße muss der Bewerber/Bieter gemäß § 160 Abs. 3 Nr. 1 GWB innerhalb von 10 Tagen nach Kenntnisnahme rügen.
(2) Verstöße gegen Vergabevorschriften, die aufgrund der Bekanntmachung erkennbar sind, sind nach § 160 Abs. 3 Nr. 2 GWB spätestens bis zum Ablauf der in der Bekanntmachung benannten Frist zur Abgabe der Bewerbung oder der Angebote gegenüber dem Auftraggeber zu rügen.
(3) Verstöße gegen Vergabevorschriften, die erst in den Vergabeunterlagen erkennbar sind, sind nach § 160 Abs. 3 Nr. 3 GWB spätestens bis zum Ablauf der Frist zur Bewerbungs- oder Angebotsabgabe gegenüber dem Auftraggeber zu rügen.
(4) Ein Vergabenachprüfungsantrag ist nach § 160 Abs. 3 Nr. 4 GWB innerhalb von 15 Kalendertagen nach der Mitteilung des Auftraggebers, einer Rüge nicht abhelfen zu wollen, bei der Vergabekammer einzureichen.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
§ 132 Abs. 2 S. 1 Nr. 2 , S. 2 und Abs. 5 GWB / § 22 EU Abs. 2 S. 1 Nr. 2, S. 2 und Abs. 5 VOB/A:
Es sind zusätzliche Liefer-, Bau- oder Dienstleistungen erforderlich geworden, die nicht in den ursprünglichen Vergabeunterlagen vorgesehen waren. Der Bedarf nach einer zusätzlichen Kita-Gruppe hat sich erst anhand der aktuellen Meldezahlen im Januar 2023 ergeben.
Ein Wechsel des Auftragnehmers kann aus wirtschaftlichen oder technischen Gründen nicht erfolgen. Das Vorhaben ist eilbedürftig, weil der zusätzliche Bedarf an einer Kita-Gruppe bereits im September 2024 zur Verfügung stehen muss. Bei einer neuen Ausschreibung wäre dies nicht möglich.
Ein Auftragnehmerwechsel wäre mit erheblichen Schwierigkeiten oder beträchtlichen Zusatzkosten für den öffentlichen Auftraggeber verbunden.
Selbst bei einer Ausschreibung mit verkürzten Fristen wäre eine Inbetriebnahme bis September 2024 nicht möglich. Zumal es sich im denselben Standort handelt und ein zeitgleicher Bau durch zwei Unternehmen nicht möglich ist.
Der Preis darf nicht um mehr als 50 % des Wertes des ursprünglichen Auftrags erhöht werden. Das ist der Fall.
