Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

1. Freistellen von Mast S-99 durch Umspannen des Kettenwerks an den Mast 61-31e. Hierfür müssen die Statik geprüft sowie Bauteile materialisiert und montiert werden.

1. Freistellen von Mast S-99 durch Umspannen des Kettenwerks an den Mast 61-31e. Hierfür müssen die Statik geprüft sowie Bauteile materialisiert und montiert werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Für die Arbeiten der Fa. Strabag (Herstellen Querung für Wasserleitung und Herstellen Schächte) ist der vorhandene Oberleitungsmast S-99 im Weg. Das vorzeitige Freistellen von Mast S-99 wird erforderlich, um die Maßnahmen gemäß Bauzeitenplan durchführen zu können und somit den IBN-Termin zu halten.

Der bisherige Auftragnehmer ist für die Oberleitungsmaßnahmen im Projekt Abstellanlage Augsburg vertraglich gebunden. Gemäß erstellter und freigegebener Ausführungsplanung würde der Mast S-99 in einer späteren Bauphase rückgebaut werden. Da das frühzeitige Freistellen des Mastes unmittelbare Auswirkungen auf die Umsetzung der restlichen Ausführungsplanung hat, kann die vorgezogene Maßnahme nur durch den gebundenen Auftragnehmer erfolgen.
