Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Zum Zeitpunkt der Beauftragung der Leistung, lag die Planung zum Stromanschluss für die Elektrifizierung der Strecke sowie die Lage des Unterwerks noch nicht vor und war somit nicht Bestandteil der Beauftragung. Die aktuell vorliegende Planung zum Stromanschluss erfordert zusätzliche Kartierungen der Biotop- und Nutzungstypen, Brutvögel, Horst- und Höhlenbäume sowie Fledermäusen. Aus den Ergebnissen der Kartierungen werden notwendige Ausgleichs- und Vermeidungsmaßnahmen ermittelt und im Artenschutzfachbeitrag festgehalten. Der AN ist mit dem Gebiet vertraut und kann die Ergebnisse direkt in den derzeit in Bearbeitung befindlichen Fachbeitrag Artenschutz intergrieren. Nur der AN kann die gesammlten Daten in einen sinnvollen und zusammenhängenden Kontext mit der Gesamtkartierung setzten.
