Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Im Zuge der Entwurfsplanung wurde die Notwendigkeit erkannt, den Güterbahnhof gesamthaft zu trassieren. Die gesamthafte

Trassierung ist notwendig, um als Prüfunterlagen / Kriterien bei der späteren Prüfschleifen zu dienen. Der Trassierungsumfang

entspricht dem gesamten Gbf Wanne-Eickel, bis auf die bereits beauftragten Bereiche, die da wären Gl. 30 und der

Weichenverschub W381/388.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Für den weiteren Planungsverlauf bis hin zur späteren Planprüfung, ist die Erstellung eines Trassierungsentwurfes notwendig

geworden. Der Trassierungsentwurf soll den kompletten Güterbahnhof Wanne-Eickel umfassen. Ausgenommen die bereits

beauftrageten Teilbereiche Gl. 30 und Weichenverschub W381/388.

Ein Wechsel des Planer wäre nicht zielführend, da die zusätzliche Leistung und die Hauptleistung miteinander verzahnt sind und

zeitgleich erbracht werden müssen. Ferner müsste sich der neue Planer intensiv mit dem bereits gebundenen Planer

austauschen. Dies würde bedeuten, dass der bereits gebundene Planer, die zusätzliche Leistungen im Zuge einer

Unterstützungsleistung sowieso mit bearbeiten müsste, was eine doppelte Arbeit darstellt.
