IT-Gesamtsystem bestehend aus

— Terminalhardware (u. a. Zentraleinheit, Scanner, Bildschirme, Drucker),

— der zum Spielbetrieb benötigten Terminal-Software,

— ein Terminalmanagementsystem (TMS),

— ein RDF (Retail Digital Frontend-System) sowie

— die Erstellung des Gesamtsystems und Herbeiführung der Betriebsbereitschaft einschließlich Systemservice nach Abnahme des Gesamtsystems

Ferner sieht der EVB-IT-Systemvertrag darüber hinaus auch eine Rahmenvereinbarung vor, die den Auftraggeber nach Abnahme des Gesamtsystems bei entsprechendem Bedarf dazu berechtigt, die Lieferung von Terminals und Ersatzteilen vom Auftragnehmer zu verlangen sowie Schulungsleistungen, Weiterentwicklungen und Anpassungen des Gesamtsystems und Beratungsleistungen abzurufen.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Aktuell müssen kostenpflichtige Fehlerbehebungen in der neuen Terminal Software umgesetzt werden. So kann beispielsweise keine zufällige neue Losnummer erzeugt werden.

Diese Änderung ist unabhängig von den bereits bekannt gemachten Anpassungen für die Kundenkarten-Verwaltungsfunktionalitäten.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Behebung dieser nachträglich bekannt gewordenen Fehler ist erforderlich, damit die Terminal Software den aktuellen Anforderungen der SLSV im Vertrieb entspricht. Zielsetzung ist, dass die bisherigen Terminal Software Funktionen vollumfänglich am neuen Terminal umgesetzt werden.Ein Wechsel des Auftragnehmers kann aus technischen Gründen nicht erfolgen, da es sich um Behebungen von Fehlern in der bestehenden Software handelt, für die der Auftragnehmer die Rechte am Quellcode hat. Der Auftragnehmer ist nicht zum Verkauf des Quellcodes bereit, außerdem wäre - selbst bei einer Bereitschaft hierzu - der Wechsel des Auftragnehmers unwirtschaftlich. Ein Drittunternehmen könnte sich in einem angemessenen Zeitraum nicht in den umfangreichen Quellcode einarbeiten. Zudem könnten vertragliche und gewährleistungsrechtliche Komplikationen entstehen.
